Breaking News! Supreme Court Upholds Laws Allowing Jallikattu & Kambala

On Thursday, The Supreme Court of India upheld amendments made by Tamil Nadu, Karnataka and Maharashtra to the Prevention of Cruelty to Animals Act, 1960, preserving the traditional bull-taming sports of Jallikattu and Kambala.

Justice K M Joseph presided a 5-judge Constitution bench & held that the state amendments did not violate the Constitution and the SC’s 2014 ruling banning Jallikattu.

The bench also comprising Justices Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy and C T Ravikumar said that in its 2014 judgment, Jallikattu’s previous practices held to attract restrictions under the Prevention of Cruelty to Animals Act. However, the amendments aim to reduce animal pain and suffering. The bench further highlights that since the amendments have received the President’s assent, they are deemed valid and cannot be faulted.

The court refrains from delving into the question of Jallikattu’s cultural significance in Tamil culture, citing the need for a comprehensive examination best suited for the legislature to determine.

The bench further observed,

“We are satisfied on materials that Jallikattu is going in TN for last one century… Whether this is part of integral part of Tamil culture requires detailed analysis which exercise judiciary cannot undertake..,”

The bench stated that when the legislature has declared that Jallikattu as an integral aspect of Tamil Nadu’s cultural heritage, the judiciary will not go against the viewpoint.
